刘先生不仅下载了苹果公司的机密电路原理图，而且还将其用于他在 OpenAI 的工作中；

刘先生和 OpenAI 的其他成员非但不是不知道自己未经授权访问了苹果公司的第三方云存储，恰恰相反，他们也完全清楚这一点；

刘先生得知苹果公司对他进行内部调查后，向 OpenAI 的一位同事发出销毁证据的指示，该同事确认会遵照执行；

刘先生在 OpenAI 工作时使用的工具与苹果公司内部用于苹果开发工作的工程应用程序同名。
苹果公司指控刘在三月份使用 LTspice（一款电子工程工具）运行了电路原理图文件进行模拟。在当时的几条信息中，刘表示他的人工智能 agent 学会了运行 LTspice 并查看结果。
苹果公司认为，当商业秘密信息被输入到人工智能代理或模型中并从中学习时，这种学习 “可能会造成商业秘密的不可逆转且不断传播的使用”。
苹果公司表示，被告决定不去检查笔记本电脑，而是选择 “提出一些设备数据已经驳斥的理论”。
此外，苹果公司之所以得知刘使用了该原理图，是因为他将其用于一台 Mac mini 电脑，而这台电脑后来通过 iCloud 与他从苹果公司拿走的 MacBook 电脑同步。苹果公司现在也想获取这台 Mac mini 电脑的访问权限。
苹果公司表示，这一 “令人震惊的证据” 是支持加快此案取证进程的又一佐证
